Welcome to Nasib! These Terms of Service ("Terms") govern your access to and use of the Nasib mobile application (the "App"), provided by Nasib. These Terms apply to both Android and iOS versions of the App.
By downloading, installing, accessing, or using the Nasib App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.
The Nasib App is a divination and spiritual guidance tool designed to provide users with various forms of divination services. Its features include, but are not limited to, tarot card readings, coffee grounds interpretations, astrology charts, dream analysis, and AI-powered conversations for spiritual guidance.
You must be at least 13 years old to use the Nasib App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have reviewed these Terms with your parent or guardian and that they agree to these Terms on your behalf.
You agree to use the App only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the App. You are solely responsible for your use of the divination services and for providing accurate information within the App. The App is a tool for entertainment and spiritual guidance purposes only and should not be used as a substitute for professional medical, legal, financial, or psychological advice.
All intellectual property rights in the App and its content (excluding user-submitted content), including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by Nasib or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
The App may allow you to submit content, such as questions for readings, personal information for interpretations, images, and other data ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the App. By submitting User Content, you grant Nasib a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the App and Nasib's (and its successors' and affiliates') business, including for promoting and redistributing part or all of the App (and derivative works thereof) in any media formats and through any media channels.
Your use of the Nasib App is also governed by our Privacy Policy, which is incorporated into these Terms by this reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
The Nasib App and all its features are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Nasib does not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. Nasib does not guarantee the accuracy, completeness, or usefulness of any information provided through the App, including tarot readings, coffee grounds interpretations, astrology charts, or dream analyses. The App's divination services are provided for entertainment and spiritual guidance purposes only and should not be relied upon for making important life decisions. For professional advice, always consult with qualified professionals in the relevant fields.
To the fullest extent permitted by applicable law, in no event shall Nasib, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
You agree to defend, indemnify, and hold harmless Nasib and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account; b) a breach of these Terms; or c) User Content posted by you on the App.
Nasib reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
These Terms shall be governed and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Nasib regarding the App and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding the App.
